By accessing or using the Site, or by purchasing any product or service, you agree to be bound by these Terms. If you do not agree, please do not use the Site or make a purchase.
1. Use of the Site
You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:
- use the Site in any way that violates applicable laws or regulations;
- reproduce, distribute, or commercially exploit content without explicit written permission;
- attempt to gain unauthorized access to any part of the Site;
- transmit any harmful code, viruses, or disruptive elements.
2. Products and Digital Content
We sell digital guides, delivered as downloadable files, and separately offer consulting, tastings, and collaboration services as described elsewhere on the Site. Digital guides are normally delivered electronically, immediately or shortly after payment is confirmed. Prices, availability, and descriptions may change without notice, and we reserve the right to refuse or cancel an order at our discretion — for example, in case of a pricing or listing error.
3. Right of Withdrawal (Diritto di Recesso)
If you are a consumer residing in the European Union — meaning you are purchasing for purposes outside your trade, business, craft, or profession — you generally have the right to withdraw from a distance purchase within 14 days, without giving any reason, under the Italian Consumer Code (Codice del Consumo, Legislative Decree 206/2005, as amended) and Directive 2011/83/EU. This section explains how that right applies to what we sell.
3.1 Digital Content Delivered Immediately
Our digital guides are digital content not supplied on a physical medium. In accordance with Article 59, paragraph 1, letter o) of the Codice del Consumo, **the right of withdrawal does not apply once download or access has begun**, provided that, before completing your purchase, you:
- expressly and in advance consented to delivery starting immediately, before the end of the 14-day withdrawal period; and
- expressly acknowledged that giving this consent means you lose your right of withdrawal.
You will be asked to confirm both points via a checkbox at checkout before your purchase is completed, and this will be restated in your order confirmation email. If you do not give this consent, please contact us before purchasing so we can arrange delayed delivery and preserve your standard 14-day withdrawal right.
3.2 Services (Consulting, Tastings, Collaborations)
If you book a consulting session, tasting, or other service and ask us to begin performing it before the 14-day withdrawal period ends, you may still withdraw, but you will owe us a proportionate amount for the part of the service already performed up to the moment you notify us of your withdrawal.
3.3 How to Withdraw
Where the right of withdrawal applies, you may exercise it by sending us a clear statement (for example, by email to slowsteria.community@gmail.com) before the 14-day period expires. You may use the standard withdrawal form in Annex I, Part B of the Codice del Consumo, or any other clear statement. If your withdrawal is valid, we will reimburse all payments received from you without undue delay, and in any event within 14 days of being informed of your decision, using the same payment method you used, unless we agree otherwise.
4. Legal Guarantee of Conformity
Independently of the right of withdrawal above, if a digital product you purchase is defective, materially different from its description, or does not work as described, you remain entitled to the legal guarantee of conformity under Articles 128–135 and 135-octies et seq. of the Codice del Consumo. This guarantee cannot be waived, and it applies even where you consented to immediate delivery under Section 3.1. Please contact us at slowsteria.community@gmail.com to report an issue.
5. Refunds
- **Digital guides:** once you have consented to immediate delivery (Section 3.1) and accessed or downloaded the file, the purchase is final and non-refundable, except where the legal guarantee of conformity (Section 4) applies, or where a refund is otherwise required by mandatory law.
- **Services:** refunds follow Section 3.2, or any written agreement between us.
- Where we are required to issue a refund, it will be made to your original payment method within 14 days.
6. Intellectual Property
All content on this Site — including text, photographs, videos, graphics, logos, and design — is the intellectual property of Elena Sudnitsyna or licensed to her, and is protected by copyright and other intellectual property laws. You may view and share content for personal, non-commercial purposes with proper attribution. Any other use, including commercial use, requires prior written consent.
7. User Communications and Collaborations
If you contact us by email or through a contact form, you grant us a non-exclusive, royalty-free right to use your message for the purpose of responding to you and improving our services. We reserve the right to decline any collaboration or service request at our sole discretion.
8. Age Requirement
By accessing alcohol-related content or making a purchase, you confirm that you are of legal drinking age in your jurisdiction. The Site is not intended for individuals under the legal drinking age.
9. Disclaimers
The content on this Site is provided for informational and inspirational purposes only. While we strive for accuracy, we do not guarantee that all information is complete, current, or error-free. Wine and gastronomy recommendations reflect personal opinions and should not replace professional advice.
10. Limitation of Liability
To the fullest extent permitted by law, Elena Sudnitsyna shall not be liable for indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or any products or services purchased. Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or wilful misconduct, or excludes any right that cannot be limited or excluded under applicable law — including your rights as a consumer under the Codice del Consumo (see Sections 3 and 4 above).
11. Online Dispute Resolution (ODR)
If you are an EU consumer and a dispute cannot be resolved with us directly, you can use the European Commission's Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr. Our email address for this purpose is slowsteria.community@gmail.com.
12. Governing Law and Jurisdiction
These Terms are governed by the laws of Italy. If you are a consumer, this choice of law does not deprive you of the protection you are entitled to under mandatory provisions of the law of the country where you habitually reside. Disputes will be submitted to the courts of Italy, without prejudice to your right, as a consumer, to bring proceedings before the courts of your own country of residence where mandatory law grants you that right.
13. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date above reflects the most recent changes. Your continued use of the Site after such changes constitutes acceptance of the new Terms.
